Luckd is a brand owned and operated by Santoq Technologies Private Limited ("Santoq", "we", "us", or "our"), a company incorporated under the Companies Act, 2013, having its registered office at Om Chambers 648/A, 4th Floor, Binnamangala, 1st Stage, Indiranagar, Bengaluru – 560038.
This document is an electronic record in terms of the Information Technology Act, 2000 and rules thereunder as applicable. By accessing, browsing or otherwise using the Platform, you acknowledge that you have read, understood and agree to be bound by these Terms. If you do not agree, please do not use the Platform.
You must be 18 years of age or older to register, use the services, or visit or use the Platform in any manner. By registering, visiting and using the Platform or accepting these Terms, you represent and warrant that you are 18 years of age or older.
Luckd allows you to make food ordering transactions on the Platform. To use ordering features, you must register and create an account. All information provided during registration must be current, complete, true, and accurate. You are responsible for maintaining the confidentiality of your account access information and password. You shall be responsible for all uses of your account, whether or not authorised by you.
Your mobile phone number and/or email address is treated as your primary identifier on the Platform. It is your responsibility to ensure this information is kept up to date.
The Platform enables registered Users to place orders for food and beverage items listed by Merchant partners. Luckd does not own, sell, resell, furnish, provide, prepare, or cook any of the food products listed or sold on the Platform. Each listing pertains to a surprise food bag ("Bag") whose contents are curated and selected by the Merchant. The contents are not disclosed in advance and may vary from day to day. By placing an order, you acknowledge and accept this inherent characteristic of the product.
When you place an order through the Platform, a contract of sale is formed directly between you and the relevant Merchant upon confirmation of the order. Luckd acts solely as an intermediary marketplace facilitating the transaction.
The price of each Bag is set by the Merchant and is displayed on the Platform at the time of listing, inclusive of applicable taxes. Delivery charges, if any, are displayed separately at checkout.
An order placed on the Platform is a firm and binding offer by the User to purchase the relevant Bag. An order is confirmed only upon issuance of a payment confirmation by Luckd. Confirmed orders cannot be cancelled by the User except as provided in the Refund and Cancellation Policy.
Delivery is facilitated through Luckd's third-party logistics partners. Luckd does not own or operate any delivery infrastructure. Estimated delivery times are indicative only and are not guaranteed. If you are unavailable to accept delivery, Luckd reserves the right to treat the order as fulfilled and no refund shall be issued in such circumstances.
Given the time-sensitive and perishable nature of the products listed on the Platform, Luckd's general policy does not permit cancellation of confirmed orders by Users. Refunds will only be considered in limited circumstances as set out in the Refund and Cancellation Policy. Where a refund is approved, it will be processed to your original payment method or as Luckd wallet credits within 3–5 business days, at Luckd's discretion.
All payments on the Platform are processed through Luckd's authorised payment gateway partners. By providing payment details, you authorise Luckd to charge the applicable amount to your chosen payment method. For food items classified as restaurant services under the CGST Act, 2017, Luckd, as the electronic commerce operator, is liable to pay tax under Section 9(5) of the CGST Act on behalf of Merchants.
All Merchants listed on the Platform are required to hold a valid licence under the Food Safety and Standards Act, 2006 and to comply with applicable food safety regulations. Luckd does not prepare, handle, or inspect any food items. If you have any food allergy, intolerance, or specific dietary requirement, you must contact the Merchant directly prior to placing your order. Luckd does not guarantee that any Bag will be free from allergens.
You agree and undertake not to reverse engineer, modify, copy, distribute, transmit, display, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from the Platform.
You shall not use the Platform in any way that causes, or is likely to cause, the Platform or access to it to be interrupted, damaged or impaired. You are prohibited from posting or transmitting to or from the Platform any material that is threatening, defamatory, obscene, indecent, offensive, pornographic, abusive, or otherwise unlawful.
The Platform and all content on it — including but not limited to the Luckd name, logo, brand assets, interface design, text, graphics, and software — are the property of Santoq Technologies Private Limited and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on the Platform without our prior written consent.
The Platform and all content, products and services are provided on an "as is" and "as available" basis, without any representation or warranty of any kind, express or implied. Santoq does not warrant that the Platform will be available at all times or that access will be uninterrupted, timely, secure, or error-free. Price and availability information is subject to change without notice.
In no event shall Santoq, its officers, directors, employees, agents, or suppliers be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to loss of profits, goodwill, data, or other intangible losses, arising out of or in connection with your use of the Platform.
Notwithstanding anything to the contrary, Santoq's aggregate liability to you for any cause whatsoever will at all times be limited to the amount paid by you to Luckd for the specific transaction giving rise to the claim.
You agree to defend, indemnify and hold harmless Santoq, its officers, directors, employees and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses arising from your use of the Platform or your violation of these Terms.
These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or relating to these Terms shall first be subject to a 30-day period of good-faith negotiation. If unresolved, disputes shall be referred to arbitration in Bengaluru under the Arbitration and Conciliation Act, 1996, before a sole arbitrator appointed by mutual agreement. The language of arbitration shall be English.
Santoq reserves the right to suspend or terminate your account or access to all or any part of the Platform at any time, with or without cause, with or without notice, effective immediately. Any suspected fraudulent, abusive or illegal activity that may be grounds for termination may be referred to appropriate law enforcement authorities.
In accordance with the Information Technology Act, 2000 and the Consumer Protection (E-Commerce) Rules, 2020, our Grievance Officer is:
The Grievance Officer shall acknowledge the complaint within 48 hours and endeavour to redress it within 30 days from the date of receipt.
These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Santoq with respect to the subject matter hereof. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. Santoq's failure to act with respect to a breach does not waive its right to act with respect to subsequent or similar breaches.
Santoq reserves the right to amend these Terms at any time. Continued use of the Platform following notification of any change constitutes acceptance of the revised Terms.
